The Software is a diagnostic and control tool for building-automation systems. Reading, writing, commanding, or releasing a BACnet point can affect heating, cooling, ventilation, life-safety, and other systems. You are solely responsible for the actions you take with the Software and for any changes they cause. Only make changes you understand and are authorized to make, verify their effect, and relinquish any point you take command of before leaving the site.
You represent that you are authorized to access and operate the systems and networks you connect to with the Software. You are responsible for complying with all applicable laws, site policies, and safety procedures.
The Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Software will be accurate, uninterrupted, error-free, or that it will detect every device or read every value correctly.
To the maximum extent permitted by applicable law, in no event shall First Impact Development, its developers, or its suppliers be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever — including without limitation damage to or malfunction of equipment, system downtime, loss of comfort, spoilage, loss of data, lost profits, or business interruption — arising out of or in any way related to your use of, or inability to use, the Software, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not advised of the possibility of such damages.
Where liability cannot be excluded by law, it is limited to the amount you paid for the Software (if any) in the twelve months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless First Impact Development from any claims, damages, losses, or expenses arising out of your use of the Software or your breach of these Terms.
The Software is free to use for its core functions. Certain features (such as building multiple custom remotes) require a paid license. Purchases are handled by the applicable app store or checkout provider under their own terms; refunds, where offered, are governed by that provider.
We may update these Terms from time to time. Material changes will be posted on this page with a new date, and continued use of the Software after a change means you accept the revised Terms.
